Terms of Use
Draft — not yet in force1. What the ZAM Cards App Is
ZAM Cards (the "App") is a mobile application for iOS and Android published by Techween. It lets you hold digital ZAM cards issued to you by your bank, see their status and payment history, and pay merchants that accept ZAM by picking up the merchant's payment request (by scanning a QR code today; by sound or NFC where your bank enables them later) or opening a payment link, and approving the payment on your device.
The App is a window onto cards issued by your bank. Three separate relationships apply when you use it:
| Relationship | Governed by |
|---|---|
| You and your issuing bank — the card, your account, balances, limits, top-ups, fees, statements, blocking, and disputes | Your bank's card terms and conditions |
| You and Techween — the App software itself | These Terms |
| You and your bank — registering, requesting cards, activating cards and phones, link codes | Your bank's ZAM Cards Manager app and its terms |
Techween does not hold your money, does not decide whether a payment is approved, and does not know your account details. Your bank does.
2. Eligibility and Acceptance
You may use the App if you are at least [PLACEHOLDER — e.g. 18] years old (or the age your bank requires), hold or are being issued a ZAM card by a participating bank, and use a supported device you own or control.
You accept these Terms by ticking the box and tapping Accept and continue when the App first asks, before you link a card. The App records on your device which version you accepted and when. If we change these Terms in a way that matters, the App asks again before it can be used (Section 13). You can read these Terms and the Privacy Policy at any time from Settings in the App and on techween.net.
3. Getting Started: Linking a Card
- Your bank issues you a ZAM card (debit, credit, or prepaid) and gives you an 11-character link code, as text or as a QR code, in its ZAM Cards Manager app. Link codes are single-use and expire 10 minutes after they are generated.
- You type or scan the code in the App. The App registers your device with your bank, receives a card credential, and creates a signing key pair on your device. The private key stays on your device; only the public key is sent to your bank.
- The App shows the card as Pending Authentication until your bank has verified your identity through its own process (some banks use the PACI mobile identity for this; the App itself does not perform identity verification), then Pending Activation until your bank activates the card and your device, then Active. Only an Active card can pay.
- You can link several cards from one or more banks, choose a default card, and unlink a card from your device at any time.
4. Paying with the App
- A merchant creates a payment request and shows you a QR code (in store) or a ZAM Pay button and payment page (online). Where your bank has enabled it, the App can also pick up the payment reference as an inaudible tone from the merchant's device or page, or by NFC; every channel carries only the payment reference, and the steps below are the same.
- You scan the code or open the link. The App shows you the merchant's name and logo, the amount in KWD, and any description, and lets you choose which card to pay with.
- You confirm. The App asks for your device biometric (Face ID, Touch ID, fingerprint) or device passcode before approving every payment. This cannot be turned off: the payment key in your phone's secure chip will not sign without it. You can separately lock the App itself, and we recommend that you do.
- The App signs the payment details with the private key created when you linked the card and sends the signed request to your bank. Your bank verifies the signature, checks your funds or limit, and approves or declines. The merchant is told the result within seconds.
- A payment request can be approved only once and only while it is valid: 15 minutes at a till and 60 minutes online by default.
You are responsible for reviewing the merchant name and amount before approving. An approved payment is final between you and the merchant; refunds and disputes follow Section 8.
5. Your Responsibilities
- Keep your device locked with a biometric or passcode and keep its operating system up to date. The App will not run on a rooted, jailbroken or modified device, and your bank will not link a card to an Android phone whose system software has been unlocked.
- Do not share your link code, your device, or your unlock method with anyone. Anyone who can unlock your device and the App can approve payments from your cards.
- Tell your bank immediately if your device is lost or stolen, if you suspect someone else has used your card, or if you see a payment you did not make. Your bank can block the card and deactivate the device at once.
- Unlink your cards from a device before you sell, give away, or recycle it.
- Use the App only for lawful purposes and only for your own cards.
6. Notifications and Connectivity
The App notifies you when a merchant cancels (voids) a payment, when a refund reaches your card, and when your bank switches a card or this phone on or off. It does not notify you of a payment you have just approved yourself; your bank may do so through its own channels. You start a payment yourself by picking up the merchant's payment request or opening a payment link, and the result and a receipt (reference, amount, date, fee and parties) are shown in the App, with thirteen months of history and monthly statements per card. Card status changes and payment history appear when you open the card or refresh the list. The App needs an internet connection to link cards and to pay.
7. Fees
Techween does not charge you for the App. Your bank's card terms state any fees for the card itself. Your mobile operator may charge for data.
8. Problems, Refunds, and Disputes
- A payment failed or the merchant did not receive it: check the card's payment history in the App; if you were charged and the merchant shows no approval, contact your bank quoting the payment reference and, where shown, the confirmation code.
- You want a refund: ask the merchant. A merchant can reverse a payment the same day or refund all or part of it within 180 days; the refund is credited to the same ZAM card by your bank.
- You did not authorise a payment, or goods were not received or not as described: raise a dispute with your bank, which will investigate under its complaints process and the ZAM operating rules. Time limits apply, so raise it promptly.
- The App itself is not working: contact us using the details in Section 15.
The ZAM Complaints Management Process describes how banks and Techween handle complaints and the timelines you can expect.
9. Availability and Changes
We aim to keep the App available at all times but cannot guarantee uninterrupted service. Your bank's systems and the merchant's systems also need to be available for a payment to complete. We may update the App to add features, fix defects, or meet legal or security requirements, and we may require you to install an update to keep using it. We may retire older versions or older signing methods with reasonable notice; you may then need to re-link your cards.
10. Intellectual Property
The App, its design, and the ZAM name and marks belong to Techween and its licensors. You receive a personal, non-transferable, revocable licence to install and use the App on devices you control, for the purpose described in these Terms. You may not copy, modify, reverse engineer, or distribute the App, or use the ZAM marks without permission.
11. Liability
- Techween is not a party to your card agreement and is not responsible for your bank's decisions, your balances, or any merchant's goods or services.
- To the extent permitted by Kuwaiti law, Techween is not liable for losses caused by your failure to protect your device or unlock method, by your device or network, by unavailability of your bank's or a merchant's systems, or for indirect or consequential loss.
- Nothing in these Terms limits liability that cannot be limited under the laws of the State of Kuwait or your rights under Central Bank of Kuwait consumer protection rules.
12. Suspension and Termination
You may stop using the App at any time and unlink your cards. Your bank may block a card or deactivate a device under its card terms. Techween may suspend or end your access to the App if you breach these Terms, if we are required to by law or a regulator, or if we withdraw the App with reasonable notice. Ending use of the App does not close your card or account; contact your bank for that.
13. Changes to These Terms
We may change these Terms. We will publish the new version in the App and, for material changes, notify you in the App or through your bank at least [PLACEHOLDER — e.g. 30 days] before they take effect, and the App asks you to accept the new version before you can continue to use it.
14. Governing Law
These Terms are governed by the laws of the State of Kuwait. The courts of Kuwait have jurisdiction, without prejudice to your right to complain to your bank or to the Central Bank of Kuwait.
15. Contact
Techween app support: support@techween.net Postal address: [PLACEHOLDER] For card, account, and payment matters, contact your issuing bank using the details shown on your card in the App.
