Terms of Use
Draft — not yet in force1. What ZAM POS Manager is
ZAM POS Manager (the "App") is the app in which a business that accepts ZAM payments manages its tills. Its administrators use it to see the day's takings and payments, add and edit tills, link devices to tills, create keys for online checkout, set the manager PIN for voids, void payments, see balances, and manage the business's other administrators.
The App is software published by Techween. Your business's acceptance of ZAM payments, its fees and its settlement are governed by the ZAM Merchant Agreement your business signed with its bank; these Terms govern the App.
2. Who may use the App
The App is for administrators of a business that has a ZAM Merchant Agreement with a participating bank. An administrator is created by a super administrator of the business (the first one at onboarding) at one of three levels: super (everything, including other administrators), manager (tills, devices and payments) or view only (sees everything, changes nothing). Your business is responsible for whom it makes an administrator and for everything done in the App under their accounts.
3. Accepting these Terms
You accept these Terms by ticking the box and tapping Accept and continue when the App first asks, before you sign in. The App records on your phone which version you accepted and when. If we change these Terms in a way that matters, the App asks again before it can be used, and Section 12 applies. You can read these Terms and the Privacy Policy at any time from the More tab and on techween.net.
4. Signing in
You sign in with your business email address. The ZAM Service sends a one-time code to that address, valid for a few minutes; you enter it in the App, which then keeps you signed in on that phone until the session expires or you sign out. There is no password: whoever can read your email can sign in as you. Protect that mailbox, use an address only you read, and do not share codes. Each administrator must have their own email address.
5. Administering tills and payments
- Link codes. A link code turns a device into one of your tills. Send it only to the person who will link that device, and only by a channel you trust; anyone who uses it can take payments as your business.
- Checkout keys. A key for online checkout is shown once, when it is created. Store it in your website's server configuration, never in a web page or an email, and revoke it at once if it may have been exposed.
- Void PIN. The PIN lets anyone who knows it void an approved payment at a till on the same business day. Give it only to the managers who need it, change it when one of them leaves, and remember that the App cannot show it back to you.
- Voids. A void returns the customer's money. Void only a payment that should not stand, and give the reason.
- Administrators. Remove an administrator, or switch off their sign-in, as soon as they no longer need access. Switching it off ends their session within about 30 seconds.
6. Customer information you see
Payments in the App show the name each customer's bank supplies for receipts (the "display name"), authorization codes and payment references. Use them only to run, reconcile and support your sales. Do not copy them into other systems or use them for marketing. When you copy or share a payment from the App, you are responsible for where it goes.
7. Your responsibilities
- Keep your phone locked with a passcode or biometric and its operating system up to date. The App will not run on a rooted, jailbroken, emulated or modified phone.
- Sign out on a phone you will no longer use, and tell another super administrator at once if your phone or email account is lost or compromised.
- Use the App only for your own business and only as the Merchant Agreement allows.
8. Fees
Techween does not charge you for the App. Fees for accepting ZAM payments are set in your business's Merchant Agreement with its bank.
9. Availability and changes
We aim to keep the App and the ZAM Service available at all times but cannot guarantee uninterrupted service. We may update the App to add features, fix defects or meet legal or security requirements, and may require an update before the App can be used again.
10. Intellectual property
The App, its design and the ZAM name and marks belong to Techween and its licensors. Your business receives a non-exclusive, non-transferable, revocable licence to use the App for the purpose in these Terms for as long as it has a Merchant Agreement. You may not copy, modify, reverse engineer or distribute the App.
11. Liability
- Techween is not a party to your business's Merchant Agreement and is not responsible for a bank's decisions or for settlement into your account.
- To the extent permitted by Kuwaiti law, Techween is not liable for losses caused by a link code, checkout key, void PIN, email account or phone that was not protected, by actions of administrators your business appointed, by your device or network, or for indirect or consequential loss.
- Nothing in these Terms limits liability that cannot be limited under the laws of the State of Kuwait.
12. Changes, suspension and ending use
We may change these Terms; we will publish the new version in the App and on techween.net and, for changes that matter, ask for acceptance in the App at least [PLACEHOLDER — 30 days] before they take effect, except where a change is needed sooner for security or by law. Your super administrators can switch off any administrator's access, your bank can suspend your business's access under the Merchant Agreement, and Techween may suspend an account that breaches these Terms or endangers the service. When the Merchant Agreement ends, the licence in Section 10 ends with it.
13. Governing law
These Terms are governed by the laws of the State of Kuwait. The courts of Kuwait have jurisdiction.
