Terms of Use
Draft — not yet in force1. What ZAM POS is
ZAM POS (the "App") is the till app of the ZAM payment service. A merchant's staff use it to ask a customer for a payment, show the customer a QR code (and, where switched on, a payment sound or an NFC tag to tap) that the customer's ZAM Cards app picks up, and see the result within seconds. The App also shows the till's payment history and statements, can send each payment to a customer display (the ZAM Screen app), and can cancel a request or void a payment where the merchant allows it.
Three relationships apply:
| Relationship | Governed by |
|---|---|
| Your business and its bank — acceptance of ZAM payments, fees, settlement into your account, refunds and disputes | The ZAM Merchant Agreement your business signed with its bank |
| Your business and Techween — the App software itself | These Terms |
| Each customer and their own bank — the customer's card and payment | The customer's card terms |
Techween does not hold your money or your customers' money and does not decide whether a payment is approved. The customer's bank does.
2. Who may use the App
The App is for businesses that have a ZAM Merchant Agreement with a participating bank, and for the people those businesses authorise to operate their tills ("you"). Your business is responsible for everyone it lets use the App and for every action taken on a till it has linked.
3. Accepting these Terms
You accept these Terms by ticking the box and tapping Accept and continue when the App first asks, before a till is linked. The App records on the device which version you accepted and when. If we change these Terms in a way that matters, the App asks again before it can be used, and Section 14 applies. You can read these Terms and the Privacy Policy at any time from Settings in the App and on techween.net.
4. Linking a till
- An administrator of your business creates a link code for one of your tills in the ZAM POS Manager app or the merchant portal. A link code is single-use and expires after the time the administrator chooses.
- You type the code, scan it as a QR code, or open the link the administrator sends you. The App then registers the device with the ZAM Service as that till and receives a credential that it keeps in the device's secure storage.
- From then on the device acts as that till until an administrator unlinks it, or you choose Unlink device in Settings.
Do not link a device you do not control, and never share a link code: whoever uses it gets a till in your business's name.
5. Taking payments
- You enter the amount and, if you wish, a note, and the App creates a payment request. The customer pays by scanning the QR code with ZAM Cards or, where pay by sound is on, by letting their phone hear the till. The App shows Approved or Declined as soon as the customer's bank answers.
- A request is valid for a limited time (15 minutes at a till by default) and can be approved only once.
- Check the amount before you show the code. A customer approves exactly the amount you entered.
- Hand over goods or services only after the App shows the payment as approved.
- You can cancel a request that has not been paid. Where your business has set a void PIN, a manager can void an approved payment on the same business day by entering the PIN; after repeated wrong PINs voids are locked for 15 minutes. After the business day, or for part of the amount, a payment can be refunded within 180 days through the merchant portal, under the Merchant Agreement.
6. Customer information you see
For each approved payment the App shows the name the customer's bank supplies for receipts (the "display name"), the authorization code and the payment reference. Use them only to complete, record and support that sale. Do not copy them into other systems, show them to other customers, or use them for marketing. Statements you export from the App contain the same information and are your business's records to protect (see Part B, Section 2.4).
7. The customer display
You can pair the App with a ZAM Screen on the same local network by entering the code the Screen shows. The App then sends the Screen what the customer needs to see: the amount, the QR code, the note and, after payment, the result and the customer's display name. The connection between the till and the Screen on your local network is not encrypted. Pair them only on a private network your business controls, never on a public or guest Wi-Fi.
8. Your responsibilities
- Keep each till device locked with a passcode or biometric when unattended, keep its operating system up to date, and use it only on networks you trust.
- The App will not run on a rooted, jailbroken, emulated or modified device.
- Unlink a device before you sell, give away, repair or recycle it, and tell an administrator at once if a till device is lost or stolen so the till can be unlinked.
- Keep the void PIN known only to the managers who need it.
- Use the App only for genuine sales by your business, and only as the Merchant Agreement allows.
9. Fees
Techween does not charge you for the App. Fees for accepting ZAM payments are set in your business's Merchant Agreement with its bank. Your mobile or internet provider may charge for data.
10. Availability and changes
We aim to keep the App and the ZAM Service available at all times but cannot guarantee uninterrupted service; the customer's bank and phone must also be reachable for a payment to complete. Keep another way of taking payment for when the service is unavailable. We may update the App to add features, fix defects or meet legal or security requirements, and may require an update before the App can be used again.
11. Intellectual property
The App, its design and the ZAM name and marks belong to Techween and its licensors. Your business receives a non-exclusive, non-transferable, revocable licence to install and use the App on devices it controls, for the purpose in these Terms and for as long as it has a Merchant Agreement. You may not copy, modify, reverse engineer or distribute the App, or use the ZAM marks except as the Merchant Agreement allows.
12. Liability
- Techween is not a party to your business's Merchant Agreement and is not responsible for a bank's decisions, for settlement into your account, or for the goods and services you sell.
- To the extent permitted by Kuwaiti law, Techween is not liable for losses caused by goods handed over before a payment was approved, by a till device that was not protected or was used by someone your business let use it, by your device or network, by the unavailability of a bank's systems, or for indirect or consequential loss.
- Nothing in these Terms limits liability that cannot be limited under the laws of the State of Kuwait.
13. Suspension and ending use
Your business may stop using the App at any time by unlinking its devices. A till can be unlinked or deactivated by your administrators, by your bank, or by Techween on your bank's instructions, and Techween may suspend the App for a device that breaches these Terms or endangers the service. When your business's Merchant Agreement ends, the licence in Section 11 ends with it.
14. Changes to these Terms
We may change these Terms. We will publish the new version in the App and on techween.net and, for changes that matter, ask for acceptance in the App at least [PLACEHOLDER — 30 days] before they take effect, except where a change is needed sooner for security or by law.
15. Governing law
These Terms are governed by the laws of the State of Kuwait. The courts of Kuwait have jurisdiction.
